Terms & conditions

About these terms

These terms are an agreement between you and Lima Expeditions (“Kin”, “we”, “us”). They cover the Kin apps for iPhone and Android, Kin on shared family tablets, Kin’s services, the kin.video website and the Kin waiting list.

By creating an account, using Kin or joining the waiting list, you agree to these terms. If you don’t agree, please don’t use Kin. Our privacy policy explains how we handle information. If you have a separate written agreement with us, for example for a loaned tablet or a purchase, it controls where it conflicts with these terms.

Kin is in testing

Kin is being tested with invited families. Features, supported devices and availability will change, and things can go wrong. We may pause or end the test. Kin is free during the test; if we ever charge for something, we’ll show you the price and its terms before you decide.

Your account

You must be at least 18, or the age of majority where you live if that’s higher, to create an account. Give accurate information, keep your sign-in private, and tell us at support@kin.video if you think someone else has used your account. You’re responsible for what happens in your account.

Families and sharing

A family decides who sees what is shared with it. Anyone with your family’s invite code can join, so share it only with family, and check who has joined. Creating a family doesn’t make you the owner of videos other members add.

Removing a video from a family keeps it in your library. Hiding a video changes only your own feed. Deleting a video you own removes it from Kin, as the privacy policy describes. Kin can’t recall copies someone saved or recorded outside Kin. If the person who created a family deletes their account, the family passes to its longest-standing remaining member, or is deleted if no one remains.

Your videos

You keep ownership of your videos and everything else you add to Kin. You give us a worldwide, non-exclusive, royalty-free permission to store, copy, process and display it, including with automated tools and AI models we operate, only to provide, secure and support Kin for you and the people you share with. This permission ends when you delete the content, except for the limited copies and records described in the privacy policy and what the law requires us to keep. We don’t own your videos, sell them, or use them in advertising.

Only add videos you have the right to share. You’re responsible for having permission from the people in them, including, for children, as their parent or guardian or with their parent’s or guardian’s agreement. Automatic titles, transcripts, place names and search can be wrong.

Kin is not a backup service. Keep your own copies of videos that matter to you.

Select for me and People

Select for me chooses videos on your iPhone and adds them to your library and your family without asking about each one. You’re responsible for what’s shared from your account, including what Select for me adds, so check it; you can remove any of it. People recognizes faces on your iPhone only. Use it only for your own photos and videos, and only if the people in them would be comfortable with it.

Rules for using Kin

  • Don’t add anything illegal, including any material that sexually exploits a child, and don’t use Kin to threaten, harass or bully anyone.
  • Don’t share videos that invade someone’s privacy, or that infringe someone else’s copyright or other rights.
  • Don’t try to get into an account, family or video you aren’t allowed to see.
  • Don’t disrupt Kin, get around its security, or use it to spread malware, spam or scams.
  • Don’t copy, resell or offer Kin as your own, or reverse engineer it except where the law allows.

Reports and enforcement

To report harmful content, a privacy problem or a copyright issue, write to support@kin.video with enough detail for us to find it and understand the problem. Privacy and deletion requests can also go to privacy@kin.video.

Send copyright notices to our designated agent at support@kin.video, with the information 17 U.S.C. 512(c)(3) requires: your signature, the work, where it appears in Kin, your contact details, a statement of good-faith belief that the use isn’t authorized, and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for them. We close the accounts of repeat infringers. We report apparent child sexual abuse material to the National Center for Missing & Exploited Children, as US law requires.

We may remove content, or suspend or close an account, when someone breaks these terms, to keep people safe, or when the law requires it. We may act at once for urgent safety or security issues. If we act on your content or account and you think we’ve made a mistake, write to us and we’ll look again.

Kin’s apps and software

We give you a personal, non-exclusive, non-transferable permission to use Kin’s apps on devices you own or are allowed to use, for your family’s videos. Kin’s software, name, designs and services belong to us or our licensors. Open-source parts of Kin are covered by their own licences.

If you downloaded Kin from Apple’s App Store, these terms are between you and Lima Expeditions, not Apple, and Lima Expeditions, not Apple, is solely responsible for Kin and its content, maintenance and support. Use Kin only on Apple devices you own or control, as the App Store’s Usage Rules allow. Apple has no obligation to provide support or maintenance for it, and isn’t responsible for any claims about it, including product liability, legal compliance or intellectual-property claims. If the app fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; Apple has no other warranty obligation for the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Apple’s own terms for apps also apply. You confirm that you’re not in a country under a US government embargo and not on a US government list of restricted parties. If you got Kin from Google Play, Google Play’s terms also apply.

Shared tablets

A family tablet stays in Kin and updates itself. Keep it plugged in and on Wi-Fi as we suggest, and contact us if it needs help or has to come back. Who owns a supplied tablet, how long you can keep it, and what happens if it’s lost or damaged are agreed separately when you receive it.

Memories and the waiting list

Memories, the Kin video book, is in development. The pictures on our website are concept renders, and its design, materials, features, price and timing aren’t final.

Joining the waiting list asks us to contact you about Memories by email or phone, as the privacy policy describes. It isn’t an order, a reservation or a promise of a book, a price or a place in line, and it costs nothing. You can leave at any time by writing to support@kin.video. If we offer Memories for sale, the offer will set out its price, payment, shipping, returns and warranty, and your rights under consumer law.

Other companies’ services

Kin works with other companies’ services, such as Google sign-in, Google Photos, your phone’s maps and speech recognition, and the app stores. Their own terms apply when you use them, and their availability can change without us. Connecting Google Photos lets Kin receive the videos you choose; it doesn’t let Kin change or delete anything in your Google Photos.

Place names in Kin come from OpenStreetMap data, © OpenStreetMap contributors, available under the Open Database License.

Messages from Kin

We’ll send you messages Kin needs to work, such as sign-in emails, invitations, security notices and changes to Kin. We’ll send news and offers only if you’ve asked for them, for example by joining the waiting list, and you can stop them at any time.

Ending your use

You can stop using Kin at any time and delete your account in the app or by writing to privacy@kin.video. Deleting your account removes the content you own, as the privacy policy describes, not content other members own.

We may suspend or close your access if you break these terms, to keep people safe, or if the law requires it. Where we can, we’ll explain why and give you a chance to fix the problem first. If we stop offering Kin, we’ll give you at least 30 days’ notice where we can, so you can make sure you have your own copies of your videos.

No guarantees

We work hard to keep Kin running and your videos safe, but Kin is in testing and is provided “as is” and “as available”. To the extent the law allows, we don’t promise that Kin will always be available, free of errors, or that it will never lose content, and we disclaim implied warranties such as fitness for a particular purpose. Some places don’t allow these exclusions, so they may not all apply to you.

If you live in Quebec, No guarantees and Limits on liability apply only as far as Quebec’s Consumer Protection Act allows, and we’ll give you at least 30 days’ written notice of a change to these terms, with the old and new text and your right to stop using Kin.

Limits on liability

To the extent the law allows, Kin is not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or opportunities, arising from these terms or your use of Kin.

To the extent the law allows, our total liability for any claim about Kin is limited to the greater of the amount you paid us in the 12 months before the claim and US$100.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, for gross negligence or wilful misconduct, or any other liability or consumer right that the law doesn’t allow us to limit.

Disputes and governing law

If you have a problem with Kin, please write to support@kin.video first. Most problems can be solved that way, and we’ll try to resolve yours within 30 days.

There is no arbitration requirement and no class-action waiver in these terms. If you live somewhere whose consumer laws give you the right to bring a claim in your local courts, or to rely on your local law, nothing in these terms takes that right away.

Changes to these terms

We may update these terms as Kin changes. We’ll update the date at the top and, for significant changes, tell you in the app or by email before they take effect. If you keep using Kin after a change takes effect, the new terms apply; if you don’t agree, you can stop using Kin and delete your account. A change won’t apply to a dispute that started before it.

General

These terms and the privacy policy are the whole agreement between you and us about Kin. If part of these terms can’t be enforced, the rest still applies. If we don’t enforce a term right away, we can still enforce it later. You can’t transfer these terms to someone else. We may transfer them as part of a merger, acquisition or sale of assets, and your rights under them will continue.
